The Government has recently publicised its intention to impose greater penalties on drivers who are caught using hand-held mobile telephones. It should not be forgotten, however, that the Senior Traffic Commissioner has made it absolutely clear that it is unacceptable for vocational licence holders to use hand-held mobile phones and other electronic devices, especially whilst driving a HGV or PSV.

 

Vocational licence holders who commit this type of offence are likely to be called to driver conduct hearings. Traffic Commissioners will be keen to explore the reasons for the usage of the device. Whilst Traffic Commissioners will be considering a suspension of the driver’s vocational licence, if it is established that the driver was in fact speaking to an employer or to a customer this may well have an adverse effect on the operator’s repute.

 

It is therefore essential for Operators to have a Mobile Telephone Policy, to ensure that drivers fully understand, observe it and be aware of the consequences should they breach it.
