Simon Clarke & Millicent Dooher appear in the Court of Appeal

Guidance on new Civil Penalty Scheme For Clandestine Entrants handed down

Simon and Millicent, both barristers of SBC, appeared before the Court of Appeal to represent our client KLG Trucking SRL in their appeal against civil penalties. Both KLG and the Home Secretary were asking the Court to hand down guidance on the proper approach to be taken to the issue of penalties, and to the level of any penalties.

The Court allowed KLG’s appeal, cutting the penalties in half. In doing so the Court provided the guidance sought, setting out the circumstances when a penalty could be imposed, and in arriving at the correct level of penalty to be imposed.
