Using Phone Behind the Wheel, No Licence and No Insurance – Driver Keeps Licence

This driver was summonsed before the Magistrates on charges of using his phone at the wheel, driving not in accordance with his licence, and having no insurance. He had indicated guilty pleas by post but was summonsed to attend as the court was considering a driving ban. The advocate was able to demonstrate that the driver did not know at the time he was stopped that his driving licence was suspended as he had not received the correspondence that should have informed him that his licence had been suspended thus invalidating his insurance. He was also able to show that the personal circumstances of the driver were such that a driving disqualification would be unjust.

After hearing mitigation the Magistrates decided not to impose a driving ban.
