Transport Manager Regains Good Repute on Application to the Traffic Commissioner

This Transport Manager, represented by barrister Harry Bowyer, failed to turn up to his Public Inquiry as he had not notified his new address to the Office of the Traffic Commissioner and did not receive the call in letter. At the Public Inquiry he lost his good repute and was disqualified indefinitely. He was only aware of this state of affairs when he attempted to put himself on another licence. After some time had passed he approached SBC who advised him to take a two day CPC refresher course. A hearing was requested in order that the order of disqualification could be varied under the procedure set out in Schedule 3 of the Goods Vehicles (Licensing of Operators Act) 1995. Once the Deputy Traffic Commissioner heard that the Transport Manager had not deliberately absented himself from the Public Inquiry and of the steps that he had taken to rehabilitate himself she varied the order of disqualification to restore his good repute.
