Successful Appeal to the Upper Tribunal!
Laura Newton successfully represented a company and its director on appeal to the Upper Tribunal. The Operator had appeared unrepresented at Public Inquiry and the Traffic Commissioner, amongst other action, disqualified the director and company for a period of 3 years. This was appealed on the basis that the Traffic Commissioner had been procedurally unfair in imposing the disqualifications. The disqualification was set aside and the case will be considered afresh.
