Successful Appeal Against PHV Licence Revocation
This PHV driver had his licence revoked by Transport for London, following an allegation of fraud. Smith Bowyer Clarke were instructed to appeal this decision. Representations were made on behalf of the driver, especially focused on the insufficient evidence of any allegation being made by TfL. The Magistrates accepted the driver’s representations and agreed that there was insufficient evidence to have made any form of allegation. The appeal was allowed, and the driver was awarded the majority of his costs.
