Success Appeal Against the Traffic Commissioner

We were instructed by an Operator who had received a letter from the Traffic Commissioner revoking their Operator’s Licence. There had been a number of issues with the Operating Centre and DVSA co-operation, which the Operator was seeking to address. Laura Newton made an initial application with an Appeal to ‘stay’ the revocation. The Upper Tribunal granted the application allowing the Licence to continue pending appeal. In a hearing before the Upper Tribunal it was successfully argued that the Traffic Commissioner’s decision was flawed and the grounds for revocation were not made out on the evidence. The revocation decision was successfully overturned to the great relief of the Operator.
