Scaffolding Operator finally gets O licence at Traffic Commissioner’s Public Inquiry

The Public Inquiry was called into the applicant’s second attempt to get an O licence following the termination of a previous licence. Murray Oliver appeared for the applicant.

A question remained about the unauthorised use of goods vehicles between the time when the operator realised that the licence had terminated and the last Public Inquiry and although the systems for compliance were able to satisfy the Traffic Commissioner that they would be suitable on the previous occasion, the systems were carefully reconsidered at this hearing too.

The Traffic Commissioner listened carefully to the directors’ evidence and was satisfied that there was a good chance that the applicant could operate the required compliance systems but before he could be satisfied, which is the requirement to grant a full O licence, he felt that a 6 month time limited interim would allow the applicant to demonstrate that they could.

A satisfactory audit carried out by an independent auditor is required to prove compliance over the next 6 months and if that can be achieved the grant of a full licence will follow.
