SBC Written Submissions Lead to Operator Licence Application Subject to a “Propose to Refuse” Letter being Granted without a Public Inquiry

Our client, an applicant for an Operator’s Licence, represented at Public Inquiry by solicitor Laura Newton, was served with a proposal to refuse the Licence due to issues with a previously linked licence and questions over competence. Laura Newton in a last attempt to resolve matters, prepared a detailed proposal to the Traffic Commissioner outlining the intended compliance regime, training proposals and clarifying some of the historical events. The Licensing Office of the Traffic Commissioner replied within 24 hours advising that the Traffic Commissioner had reviewed the response and was prepared to grant the licence as requested with our proposed undertaking.
