s.31A Penalty for an Unsecured Vehicle Reduced by Almost 75%

Millicent Dooher submitted a Notice of Objection for this haulier who faced penalties of £7,500.00 for having an unsecured vehicle. There were not clandestine entrants found on the vehicle. Border Force accepted these submissions and reduced the penalty for the Company by 75%, and reduced the penalty for the driver on a means basis. The total liability was reduced by almost £5,500.00.

For penalties imposed under s.31A and s.32 of the Immigration and Asylum Act 1999, Companies are jointly and severally liable for the penalties of their employees (ie their drivers). This means that if the driver does not pay the penalty, the Company must pay, or they risk their vehicles being seized.
