PSV Operator Retains Licence at 2nd Public Inquiry, Despite 10 ‘Unsatisfactory’ and ‘Report to OTC’ Findings by the DVSA

Millicent Dooher, Barrister, represented this PSV operator at their Public Inquiry before the Traffic Commissioner. The operator was called in following a maintenance investigation for which, out of the 12 sections assessed, 10 were marked as either unsatisfactory or report to OTC. This was the second Public Inquiry this operator had been called to in the last 5 years.

Despite the Traffic Commissioner’s assertions that this was the worst report he had ever seen, Millicent was able to convince the Traffic Commissioner to allow the licence to remain, and the 10-vehicle operator was curtailed by only 2 vehicles.

It is essential that steps are taken following a DVSA investigation to improve any areas of non-compliance that are identified- this may just be the saving of your licence! Get in touch with one of our lawyers today to see what we can do for you.
