Private Hire Licence reinstated after revocation for a mobile phone offence

A Private Hire Driver convicted of a mobile phone offence was ultimately found to be a ‘fit and proper person’ following TfL’s decision to revoke the Private Hire Licence.

The driver instructed Smith Bowyer Clarke to appeal the revocation. The Solicitor, Laura Newton and Solicitor Apprentice, Jaskiran Pal thoroughly prepared the client’s evidence and advised on the steps required to strengthen his appeal.

Although the offence is classified as a major driving offence under TfL’s Driver Policy and resulted in six penalty points, the Court, having considered the evidence prepared on the client’s behalf, was satisfied that he remained a ‘fit and proper person’ and allowed the appeal, reinstating the licence.
