Phoenix and Fronting Fears overcome at Traffic Commissioner’s Public Inquiry

This applicant for a Restricted Licence, represented by Harry Bowyer, unwittingly attracted the attention of the Office of the Traffic Commissioner. She had been an extremely competent employee of a skip company. When she left the business quickly got into difficulties without her and became insolvent. In due course the applicant decided that she would apply for her own licence. Her company name was deliberately similar to the defunct company as during her time there she had personally built up a great deal of good will.

The similarities between the old company and the new company led to the application being called in to Public Inquiry. The Applicant was, however, able to demonstrate conclusively to the Traffic Commissioner that there was no sinister nexus between the applicant and the previous company and the application was granted in full
