Partnership with Wrong Entity Problems and Maintenance Shortcomings Obtains New Licence after Traffic Commissioner’s Public Inquiry

Laura Newton was instructed to represent a Partnership at Public inquiry, called to the Traffic Commissioner in respect of maintenance shortcomings. During preparation, it was also identified that the application was held by the wrong entity, and we were able to make a new application to be considered urgently at the Public Inquiry, which would allow the continuation of work. Despite serious shortcomings, the Traffic Commissioner allowed the new application to be granted with a number of conditions and no action taken against the old licence, which would expire upon a new licence being granted. Had the entity issue not been dealt with properly, the Operator risked not only serious action against the existing authority but also a lengthy delay and disruption before it would be able to continue working.
