Operator with Two Consecutive Unsatisfactory DVSA Reports Survives Traffic Commissioner’s Public Inquiry

The operator in this case, represented at Public Inquiry by Barrister Harry Bowyer, failed to take sufficient corrective action after an unsatisfactory DVSA visit and had an unsatisfactory desk based assessment 12 months later. The Traffic Commissioner was concerned that the Directors had no oversight of the operation and that the Transport Manager was not in continuous and effective control and called the operator in.

The operator was put in touch with a reputable transport consultant who put in the missing systems and provided the directors with an Operator licence Awareness Course (OLAC).

The Traffic Commissioner was impressed with the improvement and allowed the licence to continue subject to curtailment of the margin which could be reinstated subject to a satisfactory audit.
