Operator Licence Saved at Traffic Commissioner’s Public Inquiry Despite Hundreds of Instances of Missing Mileage

Our client, an Operator licenced by the Traffic Commissioner across a number of Traffic Areas, was found to have no system in place to deal with missing mileage. DVSA found hundreds on instances of missing mileage where the Operator could not account for them and had not identified these at the time. The Operator, represented by Laura Newton, was called to Public Inquiry before the Traffic Commissioner. Although they had rectified the issues, they had expected significant regulatory outcome given the serious issues which had been found. However, we were able to present the Traffic Commissioner with very clear evidence of new systems and procedures, showing that the Company was compliant in all areas of its transport activity. We were also able to present evidence relating to the impact that any regulatory action would have. Having been able to take account of all of the positives, the Traffic Commissioner settled the Public Inquiry with a Formal Warning only and no reduction in the Licence Authority.
