Operator Keeps Licence By Skin of His Teeth at Traffic Commissioner’s Public Inquiry

This Operator, represented by Harry Bowyer at Public Inquiry, had a single director who was also the main driver. This led to many of the usual problems with director’s duties colliding with rest requirements along with a generous scattering of infringements that should not have occurred with any driver let alone a director of an operator licence holding company. Maintenance issues had led to an unattractive DBA.

The director confessed in Public Inquiry to lending his truck (and therefore his licence) to a friend to retrieve the friend’s trailer. The Traffic Commissioner was not impressed.

The Traffic Commissioner was persuaded to allow the licence to continue subject to a suspension of the licence.
