Operator Keeps Licence at Third Traffic Commissioner’s Public Inquiry

Laura Newton represented an Operator of Goods Vehicle before the Traffic Commissioner at Public Inquiry. This was the Operator’s third Public Inquiry and raised questions about the failure to notify a loss of Transport Manager, consideration of a new Transport Manager nomination and a number of maintenance issues leading to a breach of the licence undertakings. At the Public Inquiry, the Operator and nominated Transport Manager gave evidence and were able to demonstrate that the Company could be trusted to operate compliantly in the future and that the Transport Manager was the suitable person for the role. In dealing with the case, Traffic Commissioner gave a formal warning and allowed the Licence to continue uninterrupted.
