O-License Application Granted in Full Despite Pattern of Failed Businesses

Barrister, Millicent Dooher, represented this Operator before the Traffic Commissioner at their Public Inquiry. The application had been called in as this was the operator’s third licence in 3 years, with both previous operator licence holding companies having entered administration.

Millicent was able to persuade the Traffic Commissioner to grant the new licence, having been able to show that the previous insolvencies occurred for legitimate reasons, and establishing the good repute of the Operator and the Transport Manager.

Previous insolvency is something that the Traffic Commissioners look very closely at as it is linked to a Director’s good repute. Insolvency does not mean you cannot get an operators licence, the Traffic Commissioner must ensure that there is no commercial advantage or financial gain obtained.
