No Further Action Following Traffic Commissioner’s Preliminary Hearing
Millicent Dooher, barrister, represented this operator at their preliminary hearing before the Traffic Commissioner following an ‘S’ marked prohibition and unsatisfactory DVSA desk based assessment. The DVSA had identified a number of areas of shortcomings within the operation, including the prohibition history, PMIs and roller brake test issues and insufficient finance. The previous Transport Manager did not hold a UK CPC.
Having heard the evidence from the Operator and submissions from Millicent, the Traffic Commissioner was able to conclude that sufficient progress had been made, and a full Public Inquiry was not necessary. Instead, the Traffic Commissioner required some undertakings from the Operator but took no further action. A quick and positive response by the Operator to find a new Transport Manager also allowed the Traffic Commissioner to be satisfied he could trust the Operator moving forwards.
