No Action Taken Against Driver Who Spilled Entire Load of Timber on A Road at Driver Conduct Hearing

This driver represented by Barrister Harry Bowyer turned his truck on its side when his load of timber shifted. The resulting parquet floor closed an A road for some hours. The Operator for whom he had worked for some years informed the Office of the Traffic Commissioner that they had dismissed the driver, were mortified at his gross disregard for Public Safety and presented the Traffic Commissioner with all of the new loading Protocols and training that they had put in place since the accident. What they did not explain was why the new protocols and training were necessary if the old ones were sufficient.

His trump card was that the local police had thoroughly investigated the matter and and had sent a letter stating that they would take no further action.

The Traffic Commissioner was well aware of the propensity of operators to throw their drivers under the bus when the SHTF and was not minded to take any action against the driver on the evidence that he had before him.
