MOT Tester’s Authority Restored following DVSA Issuing 5 Year Cessation (Disqualification)

Laura Newton was able to secure the return if MOT Authority for our client, an MOT Tester. He approached us having received a decision from DVSA issuing a 5 year Cessation (Disqualification) against his authority as an MOT Tester. The concern had been relating to a security breach on the MTS (500 points) and allegations of issuing a VT20 to a vehicle which wasn’t present. We exercised the right for an informal hearing, which allowed us to question the DVSA investigating officers and highlight the flaws in the investigation. It was clear that unfair assumptions had been made on the evidence without a thorough investigation and this led to an unfair decision. It was concluded that the appropriate decision was a 28 day cessation, which had already been served. This allowed the Tester to continue working immediately after the decision.
