Laura Newton represented an Authorised Examiner and Tester relating to a DVSA MOT investigation and Contemplated Decision. The investigation by DVSA had uncovered shortcomings in testing, specifically that a vehicle had been logged on for test for 2 days. The Authorised Examiner and Tester were criticised for failing to follow the MOT Guide, whereby the test should have been logged off once completed, and if not possible, aborted and a new test issued. DVSA Vehicle Examiners had proposed action which would have resulted in a Cessation of Authority, which would have closed the business. Following written representations, the matter was concluded by way of warning only, allowing the business and the individual tester to retain repute and authority.
