Laura Newton represented an Authorised Examiner under the MOT Scheme who was served with a contemplated decision proposing that 500 points would be imposed. This was due to DVSA carrying out an undercover observation on a Tester, who it transpired had falsified brake test results and carried out an inadequate inspection.

With written representations being submitted to DVSA, it could be shown that AE should not be accountable in these unusual circumstances. The AE had a long positive history of compliance and a good Quality Control regime. For these reasons, DVSA took a step back from formal regulatory action and the VTS was permitted to continue operating.
