More than 50% Reduction in Out of Time Civil Penalty Appeal Case for UK haulier
Barrister, Millicent Dooher, represented this UK based haulage company following the imposition of civil penalties totalling £36,000.00 following the discovery of clandestine entrants in one of the Company vehicles.
The Company had missed the correspondence and as such were out of time to appeal the matter. Millicent was able to lodge the appeal and prepare the documents. Prior to the hearing, Border Force considered the matter and offered to reduce the penalties to almost £15,000.00 in total. This was accepted by the client, especially where the client had accepted that the Regulations had not been complied with.
The time limit to lodge an appeal to the County Court is 28 days from the date of the imposition of a penalty, or a determination of an objection should a Notice of Objection be submitted. If you do not meet the 28 day time limit, the Court can refuse your appeal and you can be left with the penalties at the level they are. If you have clandestine entrant civil penalties, but have missed that time limit, get in touch with one of our barristers today and see if we can help you with your out of time appeal.
