HGV Loses Two Wheels at Roundabout – No Regulatory Action at Traffic Commissioner’s Public Inquiry

This operator, represented by barrister Helen Newbold, was called to a Traffic Commissioner’s Public Inquiry following an incident where his HGV lost two wheels whilst negotiating a roundabout. Thankfully no-one was injured nor any damage caused when the wheels parted company with the vehicle however the operator had to face severe scrutiny from the Traffic Commissioner over the incident.

The operator had taken immediate action with regards to his fleet as a result of the incident and sought out the assistance of a transport consultant to assist him in ensuring he was able to bring his methods of operating up to almost complete compliance in the period prior to the Public Inquiry. The Traffic Commissioner was concerned no DDI books were held by the operator at the time and the driver could not recall his walkaround.

The Traffic Commissioner, however, deemed that photographic evidence showed that the cause of the incident lay squarely in the hands of the maintenance provider.
The operator and the driver of the vehicle were commended on their openness and honesty by the Traffic Commissioner, as a result no regulatory action was brought against the company or the driver.
