Operator With Extensive History of Poor Compliance Curtailed to Requested Reduction

Barrister, Millicent Dooher, represented this operator before the Traffic Commissioner at a Public Inquiry. The Traffic Commissioner had concerns following an extensive history of poor maintenance compliance, an absent Transport Manager and insufficient financial standing. Prior to the hearing, the Operator had indicated that a reduction would be sought, but that a period of grace for financial standing would still be required.

Between the call in letter and the PI, the Company made significant changes to their compliance throughout their operation. This was reflected in the DVSA evidence provided at the time of the PI. Significant credit was given to the operator for this, allowing the Traffic Commissioner to take no other action than curtailing the licence to the Operator’s requested reduction in authorisation.

This is a prime example of how fixing any issues prior to the Public Inquiry can result in a positive outcome for any Operator. If you have been called in to a Public Inquiry, get in touch with one of our lawyers today.
