Formal Warning for Authorised MOT Tester and Examiner

Our clients were an Authorised Examiner and Tester under the DVSA  MOT scheme. During an investigation by DVSA, it transpired that the Tester had issued test certificates to a number of vehicles which were not present at the VTS during the time the test was logged on. We were instructed to make written representations in response to a contemplated decision, which indicated a proposed immediate cessation of authority. In presenting the mitigation on behalf of our clients, we secured a formal warning and future assurances to comply, rather than the loss of authority which would usually be the outcome in this type of case.
