DVSA Discontinue Prosecution Against PSV Driver

A driver avoided Court after DVSA was persuaded to discontinue a prosecution. Our client had been prosecuted for a number of alleged offences, including using a PSV without a Licence, without a CPC and without a Tachograph. The driver had been using an empty minibus to carry items around a film set. The Vehicle Examiners had pursued the case as if the driver had been carrying passengers. Laura Newton, Transport Solicitor, made detailed arguments to DVSA, regarding the legal requirements for the relevant instruments and the admissibility of evidence. DVSA served a Notice of Discontinuance two weeks prior to the trial date, allowing our client to be cleared without the stress of having to attend Court.
