Card Pulling HGV Driver Avoids Sentence in the Crown Court

Our client, a HGV Driver, was prosecuted by DVSA following an investigation at his place of work into Tachograph and Drivers’ Hours compliance. He was charged with 5 offences of creating a false tachograph record and an offence of failure to make a record. The prosecutor indicated that their submission at Court would be that the offences were serious enough to be dealt with at the Crown Court and a custodial sentence. Following a review of the evidence, solicitor Laura Newton was able to persuade the DVSA to drop the charges to just two false records and two failure to make a record. The Driver was fined at the Magistrates’ Court a total of £1012 and avoided a custodial sentence.
