Civil Penalty Appeal Settlement Saves Haulier Almost £11,000 with a Contribution Haulier’s Costs
Millicent Dooher, barrister, represented this European haulier after the imposition of civil penalties following the discovery of 1 clandestine entrant. The appeal was on the basis that the Company complied with the Regulations and that the driver’s penalty ought to be assessed on a means basis.
Prior to the appeal hearing, the Respondent, Border Force, accepted that the Regulations were complied with, and the penalty was reduced for the Company by 50%. A means assessment was also conducted for the driver, reducing the penalty significantly. This meant that the penalties that originally stood at £16,000.00 were reduced to just over £5,000.00.
