Card Pulling Driver Gets 28 Day Suspension Despite Multiple Offences

Smith Bowyer Clarke were instructed to represent a Driver before the Traffic Commissioner for a Driver Conduct Hearing following an investigation which found the Driver, our client, to have driven without a tachograph card inserted on multiple occasions, creating a false tachograph record. Laura Newton represented the Driver at the Conduct Hearing and was able to demonstrate the Traffic Commissioner that there was relevant mitigation t reduce the action form a lengthy suspension or revocation, which is suggested on the Senior Traffic Commissioner’s Statutory Guidance. In light of the submissions, the Deputy Traffic Commissioner imposed only a 28 day suspension, which allowed the Driver to continue in his employment.
