Bridge Strike with Hook Loader Operator receives Formal Warning in Virtual Preliminary Hearing

This operator was represented by barrister Helen Newbold in a virtual preliminary hearing to determine whether the operator should be called to a full Public Inquiry after one of their drivers hit a Network Rail bridge.  An incorrectly stowed hook loader struck the bridge causing significant damage resulting in a full road closure, a Network Rail investigation and severe delays to part of the rail network whilst the damage was assessed and repaired.

Helen Newbold took the operator through the events of the day and ensured that the Traffic Commissioner had already seen a video of the some of the measures the operator had undertaken to prevent any future incidents of this nature.  Both the operator and transport manager were able to demonstrate they had made themselves fully aware of the procedures that should be taken in the future.

The Traffic Commissioner was satisfied with the evidence provided by the operator and transport manager and decided not to take the matter forward to a public inquiry.
