In this case two brothers, each of whom had an operator’s licence and each represented by Harry Bowyer, continued to operate after their father, who was also their transport manager, died. Neither notified the Office of the Traffic Commissioner of the death of the Transport Manager and neither applied for a period of grace to obtain a new transport manager.

Neither company was fully compliant in its maintenance or drivers’ hours regimes.

The Deputy Traffic Commissioner was persuaded that this was negligence and lack of knowledge rather than attempt to gain a commercial advantage and allowed each licence to continue subject to a suspension.
