Another Successful Appeal When Driver Refused Entry to UK After Clandestine Entrants Found in Truck

This Dutch driver, represented by Simon Clarke, was found with 12 illegals in his truck at Coquelles. Again the Border Agency agreed he didn’t know about them but still refused him entry into the UK and again SBC appealed to the Immigration Tribunal on the basis that the refusal was unlawful and disproportionate – and again the Tribunal Judge agreed!!  We have noticed an increasing tendency for the Border Agency to stop drivers entering the UK using this soon to be outdated legislation.  The law says the Home Secretary can refuse entry if a person represents a genuinely serious threat to Public Policy, Public Security or Public Health.  An innocent truck driver going about his lawful duties? Seriously?
