£80,000 of Clandestine Entrant Civil Penalties Reduced to £19,000 with Full Costs for the Haulier

This European haulier faced £80,000.00 of clandestine entrant civil penalties following the discovery of 5 clandestine entrants in one of their vehicles. Millicent Dooher, barrister, prepared their case for an appeal to the County Court. Prior to the hearing, the penalties were reduced on a means basis.

At the appeal, the Court found the Company to be compliant with the Regulations and further reduced the penalties, the total liability being less than £19,000.00. The Court also awarded the haulier their full costs in bringing the appeal, these were to be paid by Border Force.
