5 Year MOT Cessation Overturned on Appeal

Smith Bowyer Clarke was instructed to represent an MOT Authorised Examiner and Tester, following an immediate 5 year Cessation. It was alleged that there had been fraudulent testing on vehicles which had not attended, but had been sighted on ANPR elsewhere in the Country. On appeal, Laura Newton representing the client, was able to demonstrate that the DVSA investigation was inadequate and that the ANPR evidence could not be relied upon in this case to demonstrate fraud. The Cessation was overturned swiftly on appeal following submission of further evidence and representation.
