5 Instances of Knowingly Making a False Record – Driver Expecting 5 Month suspension gets 4 weeks.
A driver facing five allegations of knowingly making a false record was called to a driver conduct hearing. Represented by Lisa Lyden-Cowan, the circumstances were explained to the Traffic Commissioner and mitigation put forward on the driver’s behalf. The Statutory Guidance indicates drivers who falsify records by driving without their digicard can expect to be called to a conduct hearing facing a starting point of a 4 weeks’ suspension to their licence for each offence up to 6 offences; and revocation of their licence and 12 months’ disqualification for more than 6 offences. In this case the Traffic Commissioner was persuaded to move down from the starting point to a 4 weeks’ suspension of the driver’s vocational licence.
