1 Vehicle Operator Escapes With 7 Day Suspension Following Poor Historical Vehicle Maintenance at Traffic Commissioner’s Public Inquiry

Millicent Dooher represented this Operator, called before the Office of the Traffic Commissioner for a second Public Inquiry, following an unsatisfactory DVSA maintenance investigation. There were additional allegations of use of an unauthorised operating centre. At the Public Inquiry, the Traffic Commissioner accepted that there was no use of an unauthorised operating centre, but the maintenance history was extremely poor.

The Operator had taken recent steps to improve, however the Traffic Commissioner considered the previous conduct sufficient to take regulatory action. A 7 day suspension was imposed, to start 4 weeks after the Public Inquiry to allow the Operator to subcontract their work and maintain their longstanding contract.

Millicent also represented the Transport Manager in this case. The Transport Manager retained their repute, however it was severely tarnished. This means that they can continue as a Transport Manager on this licence as well as the other licences they were nominated on.
