Operator Retains Licence following Traffic Commissioner’s Public Inquiry

This holder of a Standard National Operators’ Licence was called to a Traffic Commissioner’s Public Inquiry. The DVSA had conducted a maintenance investigation, the result of which had been unsatisfactory and there were a number of other issues of concern; the Daily Defect Reporting System was not being operated properly and there was little evidence of rectification work having been undertaken, the PMI’s contained insufficient evidence of rectification work, were not being properly signed off to signify that the vehicles were in a safe and roadworthy condition and there was insufficient evidence of regular brake testing.

 Martin Smith appeared for the Operator and after hearing his submissions the Traffic Commissioner accepted the immediate resignation of the Nominated Transport Manager and allowed a period of grace to enable a director to sit and await the result of the Transport Manager’s CPC exam. The Traffic Commissioner curtailed the Licence by removing the Operator’s margin for a period of four days.
