Operator with “S” Marked Prohibition Spared Traffic Commissioner’s Public Inquiry at Preliminary Hearing
This operator, represented at the preliminary hearing by barrister, Harry Bowyer, had his driver stop owing to a rattling noise. The cause was 6 loose wheel nuts which had nearly led to a wheel loss. Unfortunately the DVSA passed by (or didn’t) and slapped an “S” marked prohibition on the vehicle. This led to an unsatisfactory visit from the DVSA. SBC recommended a transport consultant to assess and fix the operator’s systems. At the preliminary hearing the Traffic Commissioner was less than happy with the “S” marked prohibition and the unsatisfactory Traffic Examiner’s visit but was impressed with the steps taken to fix the systems and decided on balance that the case did not need to proceed to a Traffic Commissioner’s Public Inquiry.
