MOT Authority Initially Removed for 5 Years – Reduced to 28 Days after SBC Submissions

Laura Newton represented an MOT garage, it’s Authorised Examiner and Tester, in relation to a DVSA investigation. It was alleged, and ultimately accepted, that the responsible person at the garage had demonstrated unacceptable behaviour towards an investigation examiner during a site visit. Initially, it was found that the behaviour was so serious that the authority must be removed for a period of 5 years. It was argued that this was a case where it was appropriate for DVSA to allow an oral hearing in person to appeal the decision. DVSA accepted the request and following the hearing, the cessation of authority was reduced to 28 days. This allowed the garage to stay open and ultimately saved the business.
