Appeal Allowed for Alleged “App Sharing” TFL Private Hire Driver – Costs Awarded Against TFL

Laura Newton was instructed to act on behalf of a TfL Private Hire Driver who has been subject to Licence Revocation. The case involved an application to appeal out of time which was granted. TfL had revoked the licence due to Operator concerns over app sharing. We were able to present evidence which undermined TfL’s case and could persuade the Magistrates that the driver at all times had acted honestly and professionally. The appeal was allowed and unusually, the Court granted Costs to the driver, due to the poor investigation which had led to the revocation.
