Urgent Application for Operator’s Licence Granted Upon Death of a Partner

Following the death of a Partner, Laura Newton assisted a business to secure continuity of their authority to Operate HGVs. A traditional partnership terminates upon the death of a Partner, which means that the Operator’s Licence automatically comes to an end. An urgent application was made to the Traffic Commissioner who allowed the business to continue operating under emergency provisions. We then assisted with a new application, made under Schedule 4 of the Goods Vehicles (Licencing of Operator’s) Act 1995. This includes special provision for the transfer of Operating Centre to a new entity, in this case a Limited Company, without the need to advertise. Liaising with the Central Licencing Office, a new Interim Licence was secured within 14 days.
