“Uncooperative” Operator has no Action Taken Against them at Traffic Commissioner’s Public Inquiry
Transport solicitor Laura Newton represented an Operator applicant at Public Inquiry. The Operator had failed to provide adequate evidence of financial standing over a prolonged period of time, following an application for increase of authorisation and subsequent investigation. Despite the Traffic Commissioner finding that the Operator had been uncooperative during the investigation and failing to meet financial standing at the hearing, the Traffic Commissioner was prepared to grant a period of grace, allowing the Licence to continue without any regulatory action.
