Licence Allowed to Continue at Traffic Commissioner’s Preliminary Hearing Despite Breach of Undertaking

The operator in this matter, represented at the preliminary hearing by barrister Harry Bowyer, had undertaken that her life partner would have nothing to do with the company as he had his own operator licence. Her partner’s business failed owing to the Covid 19 pandemic and he became involved in her business as they struggled to save something out of the wreckage. The business, which was not entirely dependant on the operator licence, stopped operating HGVs under the licence and declared the position to the Traffic Commissioner who asked for a written explanation followed by a preliminary hearing. Having heard evidence and lifted the undertaking subject to an undertaking for an audit and a formal warning for breaching the undertaking.
