Advised and represented at Public Inquiry by Simon Clarke, this Operator was called-in to answer allegations of operating from an unauthorised Operating Centre located in a different Traffic Area from his authorised OC, repeated use of vehicle not on his licence, an almost complete absence of any compliance or maintenance records, and much more. These issues came to light during a DVSA Maintenance Inspection following an application for a new Operators’ Licence in a different Traffic Area and the surrender of his existing licence – in short, he wanted to move his operation. We were called in at an early stage and were able to ensure that, by the time he came to Public Inquiry, his operation was fully-compliant: in the words of the Vehicle Examiner who conducted the original DVSA Maintenance Inspection, the operator had demonstrated a “dramatic, dramatic improvement”. The Traffic Commissioner allowed the Operator to surrender his existing licence and granted the new licence as applied for.
