Runaway Bus – Operator keeps licence at Traffic Commissioner’s Public Inquiry

The Operator in this matter, represented by Barrister, Helen Newbold, was called into Public Inquiry after an unmanned PSV left the Operating Centre and came to rest on a busy carriageway.
The Traffic Commissioner also wished to address severe concerns over how the company were meeting the financial standing required using only a loan agreement which had not been drawn.
After hearing from three DVSA Traffic and Vehicle Examiners, Helen Newbold was able to take the operator partnership through all the issues which concerned the Traffic Commissioner in a clear and precise manner. Changes that had been, and were being, implemented were demonstrated to the satisfaction of the tribunal.
A debate regarding the legal entity and finances of the company resulted in a very generous  period of grace of 5 months being granted in order that the company could meet its commitments, with no further sanctions imposed at this time.
