Operator Satisfies Traffic Commissioner That There Was no Use of an Unauthorised Operating Centre

The operator in this matter, represented by barrister Harry Bowyer, had a waste station outside the traffic area in which they held a licence. The DVSA noticed that trucks were visiting the site and sometimes stayed the night. The operator was able to show that the trucks were not kept in the yard when “not in use” but that tramper drivers sometimes overnighted at the site when delivering or picking up loads and trucks would visit the site when booked into a local (on the same industrial estate) maintenance provider. The TC accepted that there was no deliberate attempt to circumvent the rules on operating centres. The operator applied for a new licence to avoid any doubt about the grey area which was granted as applied for.
